Review hearing on caretaker government system on November 17

The hearing of three separate review petitions filed against the decision to annul the Thirteenth Amendment to the Constitution which introduced the caretaker government system during the election will be held on November 17, 2024.

The Appellate Division headed by Chief Justice Syed Refat Ahmed fixed this day on Thursday (October 24) morning.

Earlier on Wednesday (October 23), Jamaat-e-Islami filed a review application against the verdict of repealing the Thirteenth Amendment of the Constitution. The party’s general secretary Mia Golam Parwar filed a review petition in the Appellate Division.

Earlier, on Wednesday (October 16), BNP Secretary General Mirza Fakhrul Islam Alamgir filed a review application against the verdict of repealing the Thirteenth Amendment. After the fall of the Awami League government on August 5, he applied for this review in the relevant branch of the Appellate Division of the Supreme Court.

In addition, last Tuesday (August 27) against the decision to cancel the Thirteenth Amendment of the Constitution related to the abolition of the caretaker government system, the editor of Dr. Sujan. Badiul Alam Majumdar filed a separate review application.

It should be noted that the Thirteenth Amendment of the Constitution was adopted by the National Parliament in 1996, including the non-partisan caretaker government system during the election period. In 1998, three lawyers including Advocate M Salim Ullah filed a writ in the High Court challenging the validity of this amendment. On 4 August 2004, the High Court Division dismissed the writ and the caretaker government system was declared valid.
